Handling the Intersection of Federal Leave and ADA Accommodations Complexities

When employees request disability or medical-related time off from work, employers must consider federal, state, and local leave laws such as the Family and Medical Leave Act (“FMLA”) and the Americans with Disabilities Act (“ADA”).  Although the laws differ in both subject and scope, cases involving medical leave often require employers to consider obligations under both the FMLA and ADA.  In this session, Alyssa will discuss best practices for management and human resources’ handling of such leave and accommodations requests under the FMLA and ADA, the interplay between an employer’s obligations under both laws, and how the two laws interact.  

About the Speaker

Alyssa Testo is an Associate Attorney in the Washington, DC Region office of Jackson Lewis P.C., a national workplace law firm that exclusively represents employers and management.  Alyssa helps employers reduce workplace risk and manage legal costs by preventing and resolving disputes with their employees.  When litigation is unavoidable, Alyssa vigorously defends employers in state and federal court, arbitrations, and before administrative agencies such as the EEOC and DOL.  Alyssa has a proven track record of successfully defending employers in cases arising under Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family and Medical Leave Act, the Fair Labor Standards Act, and state law torts. Alyssa lives in Sterling with her husband and two rescue dogs.  Outside of her family and the law, Alyssa enjoys gardening, yoga, and re-watching “Friends” on a continual loop.
