This presentation will focus on the recently extended (until September 19) temporary allowance by U.S. Immigration and Customs Enforcement (ICE) for virtual I-9 completion, as well as any new guidance U.S. Citizenship and Immigration Services (USCIS) may issue. Hudaidah Bhimdi will address the legal and practical compliance issues employers can anticipate when resuming business operations, bringing employees back to the workplace in Return to Business (RTB) phases, and maintaining compliance for those whose employees continue to work remotely. The panel will end with providing guidance on how to address an ICE I-9 audit and what precautions to take in order to avoid an I-9 audit.
From small businesses to the private sector companies, common mistakes of completing the Form I-9 don't differ much. Some of the common mistakes employers make when completing Form I-9 ranges from incomplete information, missing signatures, meeting the three day statutory time requirement, and more.

You will also be provided the latest guidance from ICE and the Department of Justice (DOJ) on conducting internal I-9 audits to prepare you if ICE shows up. Lastly, we will discuss the recently extended temporary allowance by ICE for virtual I-9 completion.

Hudaidah Bhimdi is a partner at Murray Osorio, PLLC. Her experience is far-reaching on an array of immigrant and nonimmigrant matters ranging from a high-volume of routine cases to complex issues requiring creative solutions. Hudaidah has a particular expertise in worksite enforcement and leads the firm's worksite compliance group. Hudaidah regularly counsels clients regarding I-9 compliance, E-Verify and H-1B Labor Condition Application (LCA) compliance.
She has in-depth expertise in guiding clients through the labor certification process, including planning, performing the labor market test, and responding to audit requests by the Department of Labor. She is responsible for managing internal and ICE I-9 audits, as well as worksite compliance efforts, including assisting employers in testing and troubleshooting I-9 and onboarding software.
For temporary employment-based visas, Hudaidah has considerable experience in obtaining a diverse roster of nonimmigrant visas, including H-1B, L-1, TN, O-1, E-1 and E-2, and E-3. She also has significant experience handling immigrant worker petitions (green cards) for professionals, advanced-degree individuals, multinational managers and executives, as well as skilled workers. During her years of practice, Hudaidah has acquired in-depth knowledge of the PERM Alien Labor Certification process, having successfully secured Labor Certifications from the U.S. Department of Labor for her clients.
